All orders are governed by these General Terms and Conditions of Sale.<\/p>\n<p>Before placing orders or purchasing products and services from entities other than the Seller, NICOLETTA FASANI advises customers to review their sales conditions, as the Seller is not responsible for services provided by third parties or for electronic commerce transactions conducted between users of\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>\u00a0and third parties.<\/p>\n<p>These General Terms and Conditions of Sale fully comply with the \u201cCode of Online Rights in the EU\u201d drafted by the European Commission and published by the Publications Office of the European Union, effective since 2012.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p><strong>Article 2: Customer<\/strong><\/p>\n<p>NICOLETTA FASANI offers products for sale on\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>\u00a0and conducts its e-commerce activities exclusively for its end-users who are \u201cconsumers.\u201d The term \u201cconsumer\u201d refers to the individual identified under Article 3(a) of Legislative Decree 206\/2005.<\/p>\n<p>The resale or distribution of NICOLETTA FASANI branded products purchased on\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>\u00a0is strictly prohibited.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p><strong>Article 3: Order Placement, Prices, and Invoicing<\/strong><\/p>\n<p>Access to the sales services offered by\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>\u00a0is possible through voluntary registration, invitation by another customer, or direct invitation by NICOLETTA FASANI.<\/p>\n<p>To finalize a purchase agreement for one or more products on\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>, the customer must complete the online order form and send it to the Seller electronically, following the provided instructions.<\/p>\n<p>The order form contains a reference to the current General Terms and Conditions of Sale and a summary of essential information, including:<\/p>\n<ul>\n<li>Characteristics of each product ordered and its price (inclusive of all applicable taxes);<\/li>\n<li>Available payment methods for purchasing each product;<\/li>\n<li>Delivery methods and shipping costs;<\/li>\n<li>Information about the customer\u2019s right to withdraw and procedures for returning purchased products.<\/li>\n<\/ul>\n<p>Before proceeding with a purchase by submitting the order form, customers will be asked to carefully read the General Terms and Conditions of Sale, print a copy for their records, and save or reproduce a copy for personal use.<\/p>\n<p>The order form will be stored in the database of\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>\u00a0for the time required to fulfill orders and in compliance with legal terms. If payment has already been made, the Seller will refund the amount paid by the customer in accordance with Article 8.2 of the General Terms and Conditions of Sale.<\/p>\n<p>By submitting the order form electronically, the customer unconditionally accepts and agrees to comply with these General Terms and Conditions of Sale in dealings with the Seller. If the customer does not agree with any terms outlined in the General Terms and Conditions of Sale, NICOLETTA FASANI advises against submitting an order form for purchasing products on\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>.<\/p>\n<p>Once the contract is finalized, the Seller will send an order confirmation email containing a summary of the information included in the order form (product details, prices, payment methods, and delivery costs).<\/p>\n<p>To ensure better service quality and product availability, NICOLETTA FASANI reserves the right to limit the number of products that each customer can purchase on\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>.<\/p>\n<p>Product prices on\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>\u00a0are expressed in Euros and include all applicable taxes. Prices are valid exclusively for Italy.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p><strong>Art. 4: Product Compliance on\u00a0<\/strong><strong><a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a><\/strong><\/p>\n<p>On\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>, only high-quality products from the NICOLETTA FASANI brand collection are offered for sale. The materials used to create the products available on\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>\u00a0are produced directly by the Seller.<\/p>\n<p>The Seller does not sell used, irregular, or lower-quality products than the corresponding market standards.<\/p>\n<p>The essential characteristics of the products are presented on\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>\u00a0in each product sheet.<\/p>\n<p>However, the images and colors of the products offered for sale on\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>\u00a0may not correspond to the actual ones due to the effects of the Internet browser and monitor used.<\/p>\n<p>Product prices may be subject to updates. Customers are advised to confirm the final sale price before submitting the order form.<\/p>\n<p>In the event of the right of withdrawal, the Seller reserves the right not to accept the return of products without the corresponding tag, products that have been altered in their essential and qualitative characteristics, or products that have been damaged.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p><strong>Art. 5: Payments<\/strong><\/p>\n<p>For the payment of the product price and the related shipping and delivery costs, the customer may choose one of the available methods indicated in the order form (PayPal, bank transfer).<\/p>\n<p>The debit on the customer\u2019s bank account will occur 24 hours after the order date, and the order will only be considered effective after approval by the banking payment centers. If payment is made via PayPal, the debit or rejection will be immediate.<\/p>\n<p>Such information will never be used by the Seller except to complete purchase procedures and issue refunds for product returns, exercise the right of withdrawal, or report fraud to law enforcement agencies if necessary.<\/p>\n<p>According to Privacy regulations,\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>\u00a0does not store customers\u2019 bank details to ensure greater security of personal data processing.<\/p>\n<p>Payment via bank transfer in advance can be made to the following account:<\/p>\n<p><strong>NICOLETTA FASANI di Nicoletta Fasani<\/strong>\u00a0at UNICREDIT bank, IBAN\u00a0<strong>IT22A0200801663000102941780<\/strong>, BIC\u00a0<strong>UNCRITMMXXX<\/strong>, within five (5) working days from the order confirmation date. If the transfer is not made within this period, the contract will automatically be considered void, and the customer will receive an order cancellation email. In any case, the products will only be shipped after NICOLETTA FASANI sees the payment credited to their account.<\/p>\n<p>The customer is required to save and print the payment details if they wish to keep a record of their bank transaction.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p><strong>Art. 6: Product Availability<\/strong><\/p>\n<p>In the case of total or partial unavailability of the product after the order has been submitted, the customer will be informed via email about the order cancellation or the partial delivery of the order.<\/p>\n<p>In case of product unavailability, the customer may request:<\/p>\n<ul>\n<li>the delivery of an identical product or service of equivalent quality and price, subject to stock availability; or<\/li>\n<li>a refund for the price of the ordered product or service within thirty (30) days from the customer\u2019s request.<\/li>\n<\/ul>\n<hr class=\"wp-block-separator\" \/>\n<p><strong>Art. 7: Product Delivery<\/strong><\/p>\n<p><strong>Delivery Address<\/strong><\/p>\n<p>The products or services will be shipped to the delivery address provided by the customer during the order process. Shipping and preparation costs include Italian VAT. The customer will be notified of the shipment via email.<\/p>\n<p>The products and\/or services will be accompanied by a Delivery Note indicating the contents of the package.<\/p>\n<p>NICOLETTA FASANI delivers its products within Italy, including islands, except for Campione d\u2019Italia, the Republic of San Marino, and Vatican City, using UPS or a similar courier service. Customers can choose the delivery location: their residence, workplace, a third party\u2019s address, or their vacation location.<\/p>\n<p>If the customer is absent at the delivery address, a notification will be left in the mailbox. After two failed delivery attempts, the package will remain available with the carrier for five days following the second notification date.<\/p>\n<p>If this period is exceeded, the package will be returned to NICOLETTA FASANI. Customer Service will contact the customer to arrange a new shipment. If no response is received from the customer within a reasonable time, a refund will be issued.<\/p>\n<p><strong>Delivery Timeframe<\/strong><\/p>\n<p>The maximum delivery period is twenty working days (excluding Saturdays, Sundays, and holidays) from the order date unless otherwise specified before the order confirmation. In such cases,\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>\u00a0will provide the customer with a different delivery timeframe.<\/p>\n<p><strong>Delivery Delays<\/strong><\/p>\n<p>In case of a delivery delay, the customer can contact\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>\u00a0Customer Service at\u00a0<strong><a href=\"mailto:info@nicolettafasani.com\">info@nicolettafasani.com<\/a><\/strong>.<\/p>\n<p><strong>Non-Delivery<\/strong><\/p>\n<p>The customer has the right to cancel the order if delivery does not occur within ten working days after the delivery date indicated by\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>\u00a0unless the delay is due to force majeure.<\/p>\n<p>Within thirty (30) working days from the order cancellation request, NICOLETTA FASANI will issue a refund to the customer.<\/p>\n<p><strong>Delivery Confirmation<\/strong><\/p>\n<p>Each delivery is considered complete when the product or service is made available to the customer by the courier.<\/p>\n<p>Without prejudice to the right of withdrawal outlined in Article 8, customers should check the shipment upon delivery and report any issues or defects they find, including refusing the package if it shows signs of tampering or damage. These claims must be noted on the delivery slip and communicated to\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>\u00a0by email at\u00a0<strong><a href=\"mailto:info@nicolettafasani.com\">info@nicolettafasani.com<\/a><\/strong>\u00a0within one (1) working day (24 hours) of delivery.<\/p>\n<p>If the courier does not allow claims on the delivery slip, the customer is advised to reject the goods.<\/p>\n<p>The\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>\u00a0Customer Service will open an investigation with the courier. Customers will receive an email notifying them that an investigation has been initiated. Response times from the courier to\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>\u00a0are generally thirty working days.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p><strong>Art. 8: Right of Withdrawal<\/strong><\/p>\n<p>The goal of NICOLETTA FASANI is to ensure complete customer satisfaction. If, for any reason, the customer is not satisfied with their order, they can exercise their right of withdrawal without any penalty within ten (10) working days from the date the customer received the products purchased on\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>.<\/p>\n<p>The products to be returned must be shipped within 10 working days from the date of receipt. Returns can be made by shipping the package via Poste Italiane only after completing the Return Form available online in the Customer Service area to obtain a return number.<\/p>\n<p>It is not possible to exchange the chosen item for another.<\/p>\n<p><strong>8.1: Conditions for Exercising the Right of Withdrawal<\/strong><\/p>\n<p>The right of withdrawal will be considered correctly exercised if the following conditions are entirely met:<\/p>\n<ul>\n<li>The Return Form must be properly completed and sent electronically to\u00a0<strong><a href=\"mailto:info@nicolettafasani.com\">info@nicolettafasani.com<\/a><\/strong>\u00a0within ten (10) working days from the delivery date. The communication can also be sent within the same timeframe via registered mail to NICOLETTA FASANI,\u00a0<strong>Via PAOLO MANTEGAZZA 36, 20156 MILAN<\/strong>.<\/li>\n<li>The products must not have been used, worn, washed, or damaged.<\/li>\n<li>The products must be returned in their original packaging, in perfect resalable condition (for design objects and fashion accessories, the packaging must be sealed as originally).<\/li>\n<li>Products returned by the customer must be sent to NICOLETTA FASANI in a single shipment via Poste Italiane using the Paccocelere service. NICOLETTA FASANI reserves the right to refuse items from the same order returned and shipped at different times.<\/li>\n<\/ul>\n<p>If the customer has met all the required conditions, NICOLETTA FASANI will refund the purchase price of the products, while the customer will bear the return shipping costs for returning the products to NICOLETTA FASANI.<\/p>\n<p>The customer will be contacted if the return cannot be accepted because it does not comply with the above conditions. In this case, the customer can choose to have the purchased products returned at their own expense.<\/p>\n<p>If the customer refuses this shipment, NICOLETTA FASANI reserves the right to retain the products and the corresponding amount for the purchase of the products.<\/p>\n<p><strong>8.2: Refund Times and Methods<\/strong><\/p>\n<p>After NICOLETTA FASANI receives the return and verifies that all requirements have been met, the customer will receive an email confirming acceptance of the return.<\/p>\n<p>The actual time for crediting or refunding the amounts paid for product purchases depends on the payment method used:<\/p>\n<ul>\n<li>PayPal purchase: The refund will be made to the customer\u2019s PayPal account and will be immediately visible. The actual refund to the credit card linked to the PayPal account depends on the card issuer.<\/li>\n<li>Bank transfer payment: The refund will be credited to the bank account provided by the customer, so the refund time depends on the accuracy of the information provided by the customer. Normally, the refund is processed within thirty (30) days.<\/li>\n<\/ul>\n<p>In the case of gifts, the refund will be made to the person who made the payment.<\/p>\n<p><strong>8.3: Product Identification Tag<\/strong><\/p>\n<p>All products sold on\u00a0<a href=\"http:\/\/www.nicolettafasani.com\">www.nicolettafasani.com<\/a>\u00a0are equipped with an identification tag, which is an integral part of the item.
